The Kummer Kaempfer Water Law team regularly works with the State Engineer (Nevada Department of Conservation and Natural Resources, Division of Water Resources), the Southern Nevada Water Authority, the Las Vegas Valley Water District, the Truckee Meadows Water Authority, the Public Utilities Commission, and various local governmental entities on behalf of clients on issues pertaining to water rights and resource management. These include various applications for surface and ground water rights, applications for changes in water rights, as well as protesting such applications, along with assisting clients avoid the forfeiture of water rights and placing the water to beneficial use.

The Water Law practice group’s attorneys are experienced in all the legal and administrative procedures and laws that stem from Title 48, the State’s guiding statute on water law, to the Truckee River Decree established in the 1800s.

Practice Highlights:

  • In 2007, Kummer Kaempfer assisted clients with water resource management issues involving several thousands of acre feet of water rights appurtenant to parcels of real property ranging in size from 10 acres to thousands of acres
  • Routinely appear on behalf of property owners, business owners, developers, and small utility companies before the Public Utilities Commission on rate issues and other regulatory compliance matters
  • Successfully represented individual property owners in Southern and Northern Nevada with respect to competing interests and assisting owners in reducing their dependence on water supplied by local municipalities through the use of validly permitted and certificated water rights
  • Represented national homebuilders, developers and large businesses on a variety of water rights transactions, as well as administrative issues with the State Engineer, Nevada Division of Water Resources
